Since the issuance of Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) Number 3 of 2023, Indonesia has officially entered a new era in land administration with the introduction of the Electronic Land Certificate or Sertifikat-el. This innovation is not merely a change in format from paper to digital, but represents a major step toward creating a clean, transparent, and reliable land administration system.
Sertifikat-el is designed to address various long-standing land administration issues, ranging from lost or damaged certificates to the most serious issue, namely forgery. With Sertifikat-el, your land ownership data is securely stored in the BPN Electronic Vault, protected by multiple layers of security.
Advantages of Sertifikat-el
Before discussing the process, it is important to understand that Sertifikat-el has the same legal validity as a physical land certificate. Its main legal basis is Regulation of the Minister of ATR/BPN Number 3 of 2023 concerning the Issuance of Electronic Documents in Land Registration Activities.
Main Advantages of Sertifikat-el:
- Forgery Protection: Sertifikat-el is authorized with an Electronic Signature and equipped with security features such as a unique QR Code that directly refers to the BPN database.
- Data Protection: Data is securely stored in BPN’s data center, eliminating the risk of documents being damaged, destroyed by fire, or lost.
- Service Efficiency: Land services, particularly transactions and data changes, can be processed more efficiently because physical documents no longer need to be processed in the same way.
- Accessibility: Landowners can access their land ownership status at any time through official BPN applications such as Sentuh Tanahku.
Issuance Process of Sertifikat-el for First-Time Land Registration
For land that is still classified as state land or customary land and has never been registered, the issuance of Sertifikat-el involves the following stages at the relevant Land Office:
Survey and Mapping (Physical Data Collection)
- Application Submission: The applicant submits an application for land rights registration along with the required initial ownership documents.
- Boundary Determination: BPN survey officers conduct field measurements to determine the boundaries of the land based on information provided by the applicant and boundary witnesses.
- Physical Data Processing: The measurement results are digitally processed into a Land Parcel Map and entered into the Computerized Land Administration System (KKP) of BPN.
Legal Data Examination
- Document Verification: BPN verifies the validity of evidence of ownership, such as Sale and Purchase Deeds, Customary Land Certificates, and other relevant documents, as well as the land ownership history.
- Announcement of Physical and Legal Data: Land data is announced at the village/sub-district office and Land Office for a specified period, generally 30 days, to provide an opportunity for interested parties to submit objections or confirmations.
- Issuance of Land Rights Decision: If there are no valid objections, BPN issues a decision determining the land rights.
Registration of Rights and Issuance of Sertifikat-el
- Registration of Rights: The name of the rights holder is officially recorded in the system.
- Generation of Electronic Documents: The BPN system automatically generates the Electronic Land Book (BT Elektronik) and Electronic Land Certificate (Sertifikat-el).
- Authorization: The electronic documents are electronically signed (TTE) by the authorized BPN official.
The issued Sertifikat-el is then stored in the Electronic Vault, and the owner receives an official digital copy along with access to their land administration account.
Process of Converting a Physical Certificate to Sertifikat-el
This process is voluntary and becomes mandatory when a transaction or change of land data takes place, such as a transfer of ownership, inheritance, or mortgage rights.
Submission of Conversion Application
- Visit the Land Office: The owner or their authorized representative visits the relevant Land Office. At present, this service is available at selected pilot Land Offices.
- Submission of Documents: Submit the Original Physical Land Certificate along with supporting documents such as an ID card, Family Card, Taxpayer Identification Number (NPWP), and the latest Land and Building Tax (PBB) payment receipt.
Verification and Withdrawal of Physical Documents
- Authenticity Verification: BPN officers verify the submitted physical certificate against the records and archives (warkah) as well as the BPN database.
- Withdrawal and Determination: Once verified, the physical certificate submitted to BPN will be withdrawn and converted into an electronic archive. Officers will prepare an Official Report of Certificate Replacement.
- Important: Once the physical certificate has been withdrawn, it no longer serves as a valid instrument of proof of land rights.
Digitization and Issuance of Sertifikat-el
- Scanning and Data Entry: Information contained in the physical certificate is entered and secured within the BPN system.
- Issuance of New Document: The system issues a new Electronic Land Certificate, stating that the certificate is the result of conversion from the previous analog/physical certificate.
- Electronic Vault Storage: The Sertifikat-el is securely stored within BPN’s data center.
Accessibility and Verification of Sertifikat-el
Once the process is completed, how can the owner access and verify the certificate?
- Sentuh Tanahku Application: The owner can download and log in to the official BPN application, Sentuh Tanahku. Through the application, they can view their land ownership information, including Sertifikat-el details.
- Printed Copy: The owner will receive a physical copy of the Sertifikat-el printed on HVS paper with specific formats and specifications. This copy must contain a QR Code.
- QR Code Verification: To verify its authenticity, parties such as notaries, banks, or members of the public can scan the QR Code using the Sentuh Tanahku application. If the information matches the data stored in the BPN Electronic Vault, the certificate can be verified as valid and authentic.
Conclusion: A Better Future for Land Administration
The Electronic Land Certificate process is a progressive step toward making land administration services more efficient, measurable, and secure, while minimizing the risk of land-related fraud and crimes. Through this digitalization, BPN not only protects your land documents but also contributes to better and more modern public governance.
